Sell Amrapali Group’s Five Star Hotel, Orders Supreme Court

The Supreme Court asked the auditors to examine the trail of around Rs 3000 crore (File)

New Delhi:

The Supreme Court on Wednesday asked forensic auditors to examine the trail of around Rs 3,000 crore, the home-buyers’ money allegedly spent by the Amrapali Group on buying shares of its sister companies and asset creation.

Amrapali Group CMD Anil Sharma, directors Shiv Priya and Ajay Kumar returned to the court a total amount of Rs 1.55 crore of home buyers money “lying” with them.

The top court grilled several accountants of the group as to how they have prepared the accounts statements which were submitted in the court and on what basis they created the accounts this year for financial years 2015-16, 2016-2017 and 2017-2018.

It directed the forensic auditors to ascertain the numbers of flats which were ‘benami’ property, doubly booked or booked on a nominal value by Amrapali Group.

A bench of Justices Arun Mishra and UU Lalit directed Debt Recovery Tribunal, Delhi to conduct the valuation of Amrapali’s five-star hotel Tech Park in Greater Noida and sell it by January end.

It also questioned Sharma about the sub-leases granted to the family members of Amrapali directors and where the Rs 3,000 crore of home-buyers’ money has gone.

The bench after failing to get a satisfactory reply asked the two forensic auditors Pawan Kumar Aggarwal and Ravi Bhatia to examine the trail of around Rs 3000 crore.

“More than Rs 2,990 crores were taken out from nine companies of Amrapali Group in the name of assets creation and purchase of shares of sister companies. You should examine the trail of the money as to how and where did it go, and the assets created by the fund”, the bench told the forensic auditors.

The court asked the company to file the details of the assets it created with Rs 2,990 crore and the board resolutions which allowed Rs 1,100 crore to be spent for purchasing share capital.

It directed the forensic auditors to also examine whether any siphoning of funds was done by granting sub-leases or any favours were doled out in such transactions.

The top court noted that pursuant to its last order in which one last window was given to the directors and other officials of the company to return home buyers money, Sharma and two directors Shiv Priya and Ajay Kumar returned Rs 1.25 crore, Rs 20 lakh and Rs 10 lakh respectively.

The court sought an affidavit from Sharma and the two directors to declare that they do not have any more money of home buyers lying with them.

The bench directed Amrapali CFO Chandra Wadhwa and statutory auditor Anil Mittal to deposit Rs 9.69 crores and Rs 27 lakh of home buyers money lying with them by January 2.

It allowed the 86 luxury cars and SUVs, which were earlier attached by the court to be brought to the corporate offices of Amrapali Group where the car dealers can hold a physical inspection and later sell them.

When Sharma was questioned by the bench about the sub-leases the company granted, he replied that firm has received over Rs 66 crore by granting sub-leases and denied any wrong doing.

“The Forensic auditors should examine the sub-leases granted by Amrapali Group by next date of hearing,” the bench said, adding that the real estate firm should comply with all the requests made by the forensic auditors in 24-hours.

The court posted the matter for further hearing on January 16.

Donald Trump’s Team On Adult Film Star Stormy Daniels Losing $293,000 In Fees

The lawsuit is one of two that Stormy Daniels has filed against Donald Trump.

A federal judge ruled Tuesday that Stormy Daniels must pay President Donald Trump more than $293,000 in legal fees in her failed defamation lawsuit, a decision that the president’s team hailed as a “total victory” but that Daniels’ attorney vowed would “never hold up on appeal.”

U.S. District Judge James Otero ruled that Daniels must pay Trump $293,052.33 in “attorneys’ fees, costs and sanctions,” a figure representing 75 percent of the amount Trump had been seeking.

Daniels had claimed in the lawsuit that Trump defamed her when he suggested that she had lied about being threatened to keep quiet about their alleged past relationship. Otero dismissed the suit in October, ruling that Trump’s “rhetorical hyperbole” was political in nature and ordering Daniels, whose given name is Stephanie Clifford, to pay the president’s legal fees.

Daniels’ attorney, Michael Avenatti, has appealed Otero’s ruling.

The lawsuit is one of two that Daniels has filed against Trump. The second seeks to invalidate a 2016 nondisclosure agreement aimed at preventing Daniels from speaking about the affair that she says she had with Trump a decade ago. Trump denies that the alleged affair took place.

Charles Harder, an attorney for Trump, hailed Tuesday’s decision as a triumph for the president.

“The court’s order, along with the court’s prior order dismissing Stormy Daniels’ defamation case against the President, together constitute a total victory for the President, and a total defeat for Stormy Daniels in this case,” he said in a statement.

Avenatti disputed that interpretation, firing back with a tweet claiming that Harder and Trump “deserve each other because they are both dishonest.”

“If Stormy has to pay $300k to Trump in the defamation case (which will never hold up on appeal) and Trump has to pay Stormy $1,500,000 in the NDA case (net $1,200,000 to Stormy), how is this a Trump win?” Avenatti said in the tweet.

While Daniels must reimburse Trump for most of his legal fees, Otero wrote Tuesday that he did not award the president the full amount he was seeking because the hours charged by his attorneys were “excessive.”

“Ultimately, Defendant’s counsel did not need to spend as much time as they did conducting legal research and compiling factual exhibits that would not properly be before this Court,” Otero wrote.

He cited as one example of the “extraneous evidence” submitted by Trump’s attorneys “a detailed list of Plaintiff’s movie history and filmography, which was unnecessary to this Court’s decision-making.”

Tata Nexon Creates History With 5 Star Global NCAP Crash Test Rating

The subcompact Tata Nexon SUV has aimed for the stars quite literally! The Nexon has the maximum possible stars with a record-creating 5 star crash safety rating from Global NCAP. The Tata Nexon is the first made in India car from any manufacturer to achieve this.

The Tata Nexon is the first ever India-made car to 5 star rating for NCAP Crash Tests

After scoring 4 stars in Global NCAP’s crash test in August this year, the Tata Nexon has made history by going the distance and becoming India’s first ever 5 Star car. The Nexon has achieved this by scoring 16.06 points out of a possible 17 – the highest as yet for any Indian made car. That this feat comes from an Indian manufacturer rather than a multinational is of significant importance. The car also underwent a side impact crash test, which is necessary to achieve this rating. Gunter Butschek, MD, Tata Motors told carandbike, “The Nexon achieving 5 stars at Global-NCAP is an exemplary achievement, and fortifies our intent for the future product portfolio.”

But what really helped the Tata Nexon to go from 4 to 5 stars? Alejandro Furas, Technical Director at Global NCAP explains, “The ABS, or anti-locking brakes, in a full channel version is a standard fitment for all the cars, so all the Nexon’s wheels have ABS in four channels. At the same time, the seat belt reminder was also now introduced by the manufacturer as a standard feature for driver and passenger side as well.” The Tata Nexon’s body shell and structure have remained unchanged since the August test, and it always had dual airbags as standard anyway. The car also retains its 3 star rating for child occupant safety.

Mayank Pareek, President, Passenger Vehicle Business Unit, Tata Motors says, “A few years back, nobody believed that safety would sell in India. However, today’s Indian customers have evolved and are better exposed to the international market. They are more conscious towards safety and have started putting vehicle safety amongst the top priorities of car purchase.”

The Tata Nexon’s earlier 4 and now 5 star rating is pushing other manufacturers into action too. And we now expect a flurry of 4 or 5 star cars from India. That is great news for the Indian industry and the Indian consumer – since these tests and results are more stringent than the newly mandated safety regulation implemented by the Indian government. “This car was entirely engineered in India and so it’s not like it required technical expertise from elsewhere. So it shows you what the Indian automobile industry is capable of. And the other thing to recognise, is that this is also the result of better crash test regulations from the Indian government. It’s a fantastic success story – a made in India success story around vehicle safety.” said David Ward, Secretary General, Global NCAP.

Mahindra Marazzo came with ABS, dual airbags, seatbelt reminder for driver & co-driver as standard

The Mahindra Marazzo has become the first-ever made in India MPV or multi-purpose vehicle to get a 4 star crash safety rating from Global NCAP. The Indian company has been working very hard to implement a new safety ethos in its manufacturing, and the Marazzo is the first vehicle to display this intent. carandbike had exclusive access to the test as always. The Mahindra Marazzo has all the safety equipment as standard, and this includes ABS, dual airbags, and even the front passenger and driver seatbelt reminder. Rajan Wadhera, President – Automotive Sector, M&M told carandbike, “This is a proud moment for Mahindra as the 4 star rating for Adult Occupation Protection reiterates our commitment towards safety. We have designed the Marazzo with many new safety features to ensure a safe ride for our customers. With Safety being at the forefront for all our vehicles, I am sure that this recognition will spur us to achieve higher safety parameters for our entire range of vehicles”.

The Mahindra Marazzo has received 4 stars for adult front occupant protection and also scored 2 stars for child occupant protection. This is also the highest score for any Mahindra car as well, and also higher than any other Indian made MPV tested so far by Global NCAP. The Renault Lodgy, Chevrolet Enjoy, and Maruti Suzuki Eeco had all failed their respective tests. The Honda Mobilio had also previously received zero stars, but a subsequent retest with dual airbags being made standard had resulted in a 3 star rating.

The Marazzo was jointly developed by Mahindra R&D in Chennai and the Mahindra Automotive North America (MANA) development centre. Representatives from both were present to witness this test. Mahindra would be proud, as this result now sets the foundation for its future products. Sources within the company say Mahindra will always aim for 4 or 5 stars and no lower for any upcoming models. The company’s next launch will be a subcompact SUV codenamed S201.

Global NCAP had the car shipped in from India a few days earlier. And it underwent a frontal offset crash test at 64 kmph – the Global NCAP test protocol – at the ADAC crash test lab near Munich, Germany. This is more stringent than the new crash norms being implemented by the Indian government, which will see cars needing a 56 kmph test. At first glance, the Marazzo appeared to have done well. Good structural integrity was visually evident, due to the lack of any deforming of the A-pillar and of any perceptible intrusions into the cabin. The analysis that was carried out in the subsequent days, presented the strong result.

A Star Is Born, If Beale Street Could Talk Expected To Lead Nominations

A Star Is Born is expected to top the nominations with nine nods. (Image courtesy: Facebook)

Los Angeles:

Hollywood’s annual carnival of awards shows begins Thursday with the nominations for the Golden Globes – the starting gun in the race for the Oscars. The announcements, which come a week before the influential Screen Actors Guild nominations, are the first major bellwether of momentum going into the Academy Awards, which take place in February. Awards analysis website Gold Derby predicts that music romance reboot A Star Is Born and If Beale Street Could Talk – a tale of black love adapted from a James Baldwin novel – will top the nominations with nine each.

A Star Is Born stars Bradley Cooper, who also directed the film, and Lady Gaga, who are also expected to pick up nominations for their portrayal of an aging rocker and the young ingenue who unite on stage and in life.

A Star Is Born should dominate with nominations at the Globes and Oscars,” Gold Derby managing director Chris Beachum told AFP.

Beale Street – the latest film from Barry Jenkins, who directed the best picture Oscar-winning Moonlight – tells the story of a young black couple in love in 1970s Harlem, and the obstacles in their path.

Beyond the frontrunners, a slew of biopics are in the mix – First Man, the intimate recounting of Neil Armstrong’s moon landing; Dick Cheney film Vice; and Bohemian Rhapsody, about Queen frontman Freddie Mercury.

Spike Lee’s BlacKkKlansman, the true story of a black police officer who infiltrated the Ku Klux Klan with the help of a white partner, is also expected to receive recognition in the drama categories.

Another theme this season is the ravages of addiction, with Beautiful Boy star Timothee Chalamet – an Oscar and Globe nominee for Call Me By Your Name (2017), tipped to earn a nod for playing a meth addict.

A Wealth Of Options

Last year, Tinseltown was looking to turn the page on the Harvey Weinstein scandal that engulfed the world of showbiz.

This year, the focus is squarely on the films.

The Golden Globes feature separate awards for dramas and musicals/comedies – meaning more nominations, and a chance for Oscar voters to consider a wider range of performances before they get their ballots.

The members of the Hollywood Foreign Press Association, who vote on the winners, also have a tendency to honor the unexpected.

A Star Is Born and Bohemian Rhapsody will compete in the drama categories, seeking to firmly establish their position before the Oscars.

Roma, the latest from Alfonso Cuaron, is eligible in the foreign film category, but the Mexican filmmaker (Gravity) could get the nod for best director.

In the musical/comedy categories, the frontrunner is – appropriately enough – The Favourite. The offbeat tale of royal deception and lust stars a powerhouse trio of actresses – Olivia Colman as Queen Anne, and Rachel Weisz and Emma Stone as the women vying for her attentions.

“Olivia Colman delivers the most shocking screen turn that’s generating the most ‘serious’ buzz in Hollywood,” writes Gold Derby founder Tom O’Neil. “Beware: The queen approaches!”

Another top prospect is Green Book, an offbeat comedy about a black classical pianist in 1960s America who hires an Italian-American bouncer as his driver for a tour of the racially divided South.

Oscar-winner Mahershala Ali and Viggo Mortenson are both expected to earn nominations.

Summer rom-com success Crazy Rich Asians and anticipated Disney sequel Mary Poppins Returns will also compete in these categories. “The HFPA members generally love musicals, so also watch for big numbers for Mary Poppins Returns.” Beachum said.

New Faces In TV Race

The Globes also honor the best in television – it can feel a bit redundant after the Emmys in September, with many of the nominees mimicking the past Emmy field.

They also can look ahead to programs that aired too late for Emmys contention, like the dark HBO mini-series Sharp Objects, Amazon drama Homecoming starring Julia Roberts, and Netflix’s offbeat Maniac with Emma Stone and Jonah Hill.

Of course, familiar top dramas like The Handmaid’s Tale, The Americans and This Is Us will also be recognised.

Thursday’s nominations will be presented before dawn in California by actors Leslie Mann (Welcome to Marwen), Terry Crews (Brooklyn Nine-Nine), Danai Gurira (Black Panther) and Christian Slater (Mr Robot).

The 76th Golden Globes take place on Sunday, January 6 in Beverly Hills. The Oscar nominations come after the Globes this year, on January 22.

Hosting the gala will be actress Sandra Oh, who could score a nomination herself for acclaimed TV drama Killing Eve, and comedian Andy Samberg, organisers announced Wednesday.

Aamir Khan, ‘Consumed by Mahabharata,’ Couldn’t Star In Rakesh Sharma Biopic, Says Film’s Writer

New Delhi:

Writer Anjum Rajabali, who was looking forward to work with Aamir Khan in the biopic on astronaut Rakesh Sharma, said that as the superstar was occupied with Mahabharata, he couldn’t do the film, reports news agency PTI. Anjum Rajabali was speaking on the sidelines of Cinestaan India’s Storytellers Contest and Aamir Khan was there too. Salute (the biopic), which is now tentatively titled Saare Jaha Se Achcha, was previously offered to Aamir, but after he backed out, Shah Rukh Khan was signed for it. “I have been very excited about the project. Like Aamir, I have been a big fan of Rakesh and now he is a good friend also. Frankly speaking, I was very keen that Aamir do it and he, at that moment, had liked it,” Anjum Rajabali told reporters, PTI reports.

“We had discussed it a lot. We had a lot of hopes for it but unfortunately (there was) the larger project of Mahabharata, which he was consumed by,” he added.

Aamir, who hasn’t yet spoken about why he opted out of the project, said that he “feels sad” for not taking it up, but is glad that Shah Rukh liked it.

“It is a great script. Salute is a wonderful script and I am a big fan of Rakesh (Sharma). It’s a wonderful story and I feel sad that I was not able to do it, which is why I called up Shah Rukh and told him it was a wonderful story and he should hear it. I am glad he liked it. All my best wishes for the project,” the 53-year-old actor said, PTI reports.

The biopic will be directed by Mahesh Mathai and co-produced by Siddharth Roy Kapur and Ronnie Screwvala.

Meanwhile, Mahabharata, a seven-part web-series, is Aamir Khan’s much-talked about project and is touted to be e made on a whopping budget of Rs 1,000 crores. After the release of Thugs Of Hindostan, it was reportedly said that Aamir will fly to the US soon to begin work on Mahabharata.

Frozen “Super Earth” Discovered Orbiting Sun’s Nearest Star

An artist’s impression of the view from the surface of the planet.

Residents of the northern hemisphere, look up: In the faint shimmy of a star above you, astronomers have discovered evidence of an alien world.

The proposed new planet is unlike anything in our own solar system, the researchers say – larger than Earth but smaller than Neptune, and far enough from its dim, red sun that any water on its surface is locked away in ice.

But this frozen “super Earth,” the second-closest exoplanet known to science, is a tantalizing clue to what else might be out there. And in the not-so-distant someday when telescopes become capable of photographing planets around other stars, it may well be the first new world we see.

“We’re moving from science fiction to science reality,” said Carnegie astronomer Johanna Teske, who contributed to a study of the new planet published Wednesday in the journal Nature. “There’s so much possibility there.”

The exoplanet’s sun, a tiny body known as Barnard’s Star, is one of our solar system’s nearest neighbors. The only stars closer are the triplet stars of the Alpha Centauri system, which is mainly visible in the southern sky. One of those stars, Proxima Centauri, is orbited by a small planet, but the star’s tendency to spew flares of deadly radiation means its planet is unlikely to be habitable.

Barnard’s Star has long been “the great white whale” of exoplanet hunting, said Carnegie astronomer Paul Butler, a co-author on the Nature paper. It’s just six light-years from our sun, and possibly twice as old. One of the main architects of exoplanet research, the astronomer Peter van de Kamp, proposed more than 50 years ago that this star could host a planet. In the 1970s, British astronomers studied the possibility of sending an uncrewed starship to probe the alien system – even though there wasn’t any evidence a planet existed to be explored.

The exoplanet’s sun, a tiny body known as Barnard’s Star, is one of our solar system’s nearest neighbors.

But it wasn’t until the first exoplanet discovery was confirmed in 1995 that the search for a world around Barnard’s Star began in earnest.

This red dwarf is a 10th the mass of our sun and too faint to be seen with the naked eye. But its low mass makes it ideal for analysis using the radial velocity technique of exoplanet detection, which exploits the way a planet’s gravitational pull makes a star wobble as it orbits around it.

A slew of telescopes on three continents have set their sights on Barnard’s Star, allowing researchers to accumulate some 800 observations over the course of 20 years. The study authors also drew on data collected by amateur astronomers.

It took the combined efforts of more than 50 researchers at some two dozen institutions, but “slowly a signal in our data came out of all the noise,” said astronomer Ignasi Ribas, who is director of the Institute of Space Studies in Catalonia, Spain, and the lead author of the Nature paper.

Barnard’s Star’s periodic wobble suggests it is circled by a large planet once every 233 days. Very few exoplanets have been found so far from their stars (planets with short orbital periods generate more frequent signals, making them easier to detect).

Because Barnard’s Star is so dim, the planet’s long orbital period puts it at the “snow line,” where sunlight is so faint that its surface is perpetually frozen. Its average surface temperature is possibly a brisk -150 degrees Celsius (-238 degrees Fahrenheit).

This puts the planet outside the traditional “habitable zone,” where conditions are thought to be ripe for life. But Teske pointed out that microbes are resilient creatures; if there is water on the planet and if other necessary ingredients are present, it’s feasible that organisms might lurk in an ocean beneath the ice.

Yet much about the planet around Barnard’s Star remains uncertain. Astronomers aren’t sure if it’s rocky like Earth or built of gas and ice, like Neptune. They know it must be at least three times as massive as Earth, but it could be even larger.

They aren’t even 100 percent certain the planet is there, Ribas noted. The research pushed the limits of the radial velocity detection technique, which becomes more difficult the farther a planet is from its star. Mathematical models suggest there is still a 0.8 percent chance that Barnard’s Star’s apparent wobble is caused by some other factor, like sunspots. For that reason, the exoplanet is deemed a “candidate,” rather than a confirmed discovery.

“Difficult detections such as this one warrant confirmation by independent methods and research groups,” Rodrigo Diaz, an astronomer at the University of Buenos Aires who was not involved in the research, wrote in a commentary for Nature. But if it’s confirmed, the “remarkable planet” would give “a key piece in the puzzle of planetary formation and evolution,” he wrote.
