Jessica Lal Murder Convict Manu Sharma Moves Delhi High Court Seeks Premature Release

The convict in the Jessica Lal murder case, Siddhartha Vashishta, also known as Manu Sharma, has moved the Delhi High Court, seeking premature release from prison.

The move comes a month after the court ordered the forthwith release of former Youth Congress leader Sushil Kumar Sharma, who had served over 23 years in prison for the murder of his wife Naina Sahni in 1995.

The high court on December 21 last year, ordered Sushil Sharma’s premature release after quashing the recommendations of the Sentence Review Board (SRB), which had rejected his plea to be set free after over two decades of incarceration.

Seeking a similar relief, Manu Sharma, who was convicted and sentenced to life imprisonment for the murder of model Jessica Lal in 1999, has moved the high court.

The matter is likely to be heard on Monday by Justice Najmi Waziri.

Manu Sharma, 43, in his plea filed through advocate Amit Sahni, has sought setting aside of the October 4, 2018 SRB recommendation, rejecting his plea, as well as the December 7, 2018 order of the Delhi government, upholding the board’s view.

The convict has contended that the reports received from several authorities, including the prison, police and social welfare department of the Delhi government, have recommended his premature release from prison.

According to Manu Sharma’s petition, he has served 15 years in jail without remission and over 20 years with remission and therefore, he is eligible for grant of premature release.

Remission is part of a sentence, which is granted to an accused after assessing his behaviour and conduct during his stay in jail and the period of interim bail or parole or furlough. A remission is added to the sentence undergone by a prisoner in jail.

The petition also contends that the high court had, in a PIL on August 3 last year, directed the SRB to strictly act according to its July 16, 2004 order, which had laid down the eligibility criteria for the premature release of a prisoner.

Manu Sharma has claimed that he satisfied the eligibility conditions laid down in the said order, but the board, on October 4, declined to grant him the relief “without giving any cogent reasons”, despite several reports favouring his plea for release.

He has also alleged that the SRB proceedings were not conducted in a fair and impartial manner and were liable to be set aside.

He said the SRB “acted in a biased, unfair and illegal manner” while rejecting his plea for premature release.

Manu Sharma, son of former Haryana minister Venod Sharma, was sentenced to life imprisonment by the high court in December, 2006 for killing Jessica Lal.

The trial court had acquitted him, but the Delhi High Court had reversed the order and the Supreme Court had upheld his life sentence in April, 2010.

Jessica Lal was shot dead by Manu Sharma after she had refused to serve him liquor at the Tamarind Court restaurant owned by socialite Bina Ramani at Qutub Colonnade in south Delhi’s Mehrauli area on April 30, 1999.

Top Court Panel Considering 4 Lawyers For Elevation To Delhi High Court

Supreme Court’s decision on advocates Krishnendu Datta and Saurabh Kirpal was deferred

The Supreme Court collegium has considered four advocates for elevation to the Delhi High Court and has deferred decision on two of the recommended names while the other two have been sent back, according to a resolution posted on the Supreme Court website on Friday.

The four — Krishnendu Datta, Saurabh Kirpal, Priya Kumar and Sanjoy Ghose — were among nine advocates whose names were recommended for elevation by the collegium of the Delhi High Court on October 13, 2017.

As per the January 16, 2019 resolution of the collegium comprising Chief Justice of India Ranjan Gogoi and Justices AK Sikri and SA Bobde, its decision on advocates Krishnendu Datta and Saurabh Kirpal was deferred for now and would be taken up after two-three weeks.

However, it said, “having regard to all relevant factors and material on record, the collegium is of the considered view that the proposal for elevation of Priya Kumar and Sanjoy Ghose, advocates, deserves to be remitted to the Chief Justice of Delhi High Court. The Collegium recommends accordingly.”

The Collegium had earlier cleared the elevation of five of the nine advocates whose names were recommended.

However, on September 4, 2018, it had decided to defer consideration of the proposal for elevation of these four advocates.

“For purpose of assessing merit and suitability of the these recommendees for elevation to the High Court, we have carefully scrutinised the material on record as well as the observations made by the Department of Justice in the file,” the resolution said.

Virat Kohli created history on Friday after he led India to their first ever bilateral ODI series win in Australia, following a maiden Test series triumph in 71 years and 11 tours. With this, India have finished the 2018-19 tour without losing a series Down Under. Following the remarkable win, Virat Kohli said India are feeling confident and balanced as a side ahead of the forthcoming New Zealand tour and ICC World Cup. “We have been here for a long time. It’s been an amazing tour for us. We drew the T20 series, won the Test and the ODI series. If someone gave me these results before the tour I would have taken it with both hands,” Kohli said at the post-match presentation.

Heaping praise on his team for a collective effort, Kohli added: “I am really grateful and proud of the side. It was a collective effort. We are feeling confident and balanced as a side with the World Cup in mind.”

The Indian skipper scored 46 off 62, before MS Dhoni and Kedar Jadhav stitched an unbeaten 121-run stand for the fourth-wicket to drive India past the victory line.

Kedar Jadhav scored a winning boundary as India chased down the small target of 231 runs with four balls to spare. He was unbeaten on 61 along with Dhoni not out on 87.

India lost their openers Rohit Sharma and Shikhar Dhawan for nine and 23 runs respectively. Kohli too missed out on his 49th ODI half-century and lost his wicket for 46 runs.

Talking about the wicket at the MCG, Kohli said: “It wasn’t a great wicket to bat on, so we had to take it deep, but they were professional in getting the job done.”

“We were a bit nervous but two set batsmen in knew exactly what they wanted to do. We wanted to get in a good combination. We wanted to give Kuldeep a rest and we don’t want to be too predictable as well,” he added.

Earlier, Yuzvendra Chahal claimed six wickets, his second ODI five-wicket haul, as India wrapped up the home team for 230 runs.

Kohli was all praise for Chahal, who replaced Kuldeep Yadav in the playing eleven for the decider match in Melbourne. Meanwhile, Kedar Jadhav had come in place of Ambati Rayudu.

“Chahal came in and bowled beautifully. 6/42 was magnificent. Kedar with bat and ball is always handy,” Kohli said.

“Few games against New Zealand and few more back home to strengthen the areas that we need to work on as a team,” the Indian skipper added.

Up next, India will tour New Zealand for five ODIs and three T20 Internationals, starting on January 23 in Napier.

BMW Motorrad Achieves 8th All-Time Sales High Globally In 2018

BMW Motorrad’s deliveries increased by 0.9 per cent globally in 2018 with 165,566 vehicles. The made-in-India BMW G 310 R and G 310 GS were among other top five models worldwide.

BMW Motorrad registered a growth of 0.9 per cent in premium two-wheeler sales globally with 165,566 vehicles sold at the end of December 2018, as opposed to 164,153 units delivered to customers the previous year. The manufacturer registered significant growth in several key markets across the world including India, while established markets like Europe and USA continued to be the growth drivers for the company’s motorcycle business. Helping the company build volumes were the made-in-India BMW G 310 R and G 310 GS motorcycles as one of the top five selling models. The manufacturer now is aiming to achieve a sales target of 200,000 units in the year 2020.

Speaking on the sales performance, Head of BMW Motorrad, Dr. Markus Schramm said, “2018 was another very successful year for BMW Motorrad. We achieved a sales record for the eighth time in succession. I would like to thank our customers most sincerely for the great trust they have placed in us again in 2018. The 2018 sales figure shows that our motorcycle growth strategy is taking effect. This success was achieved due to the market launch of six new models as well as the powerful BMW Motorrad product portfolio. And we still have a great deal planned for the coming years. Our ongoing model initiative in the premium segment continues. We will expand our product range with emotional and innovative new products in 2019, too. We will also be increasing our involvement in motorsport significantly. In the 2019 season, the new BMW Motorrad WorldSBK Team will be lining up at the start with the BMW S 1000 RR at the FIM World Superbike Championship (WorldSBK).”

Good performances across major European markets managed to push the sales figures for BMW Motorrad with markets like France (16,615 units), Italy (14,110 units), Spain (11,124 units) and the UK (9224 units). The company sold 13,842 units in the US, while Germany was the largest individual market for BMW Motorrad with 23,824 units sold.

In emerging markets, China became the largest market for BMW Motorrad with 7561 two-wheelers sold, growing at a rate of 35 per cent. Brazil saw 7361 units being sold registering a growth of 11 per cent. India, BMW Motorrad sold 2187 units in 2018, with nearly 1600 units of total sales contributed by the G 310 R and the G 310 GS motorcycles.

Globally, BMW Motorrad has produced 24,363 units of the G 310 R and G 310 GS since 2017 till the end of 2018. That said, the larger capacity R 1200/1250 GS and GS Adventure motorcycle are the more popular choice amongst customers with more than 51,000 units of the bikes sold. A total of 84,500 units of the R Series was sold during the last calendar year. The other models showing significant growth were the R nineT, while the S 1000 RR, S 1000 R, and S 1000 XR collectively sodl 18,773 units. The BMW K 1600 Bagger that is specific to the US market sold 8306 units, growing at a rate of 25 per cent.


Speaking on the vision for 2019, BMW Motorrad Head of Sales and Marketing, Timo Resch said, “We expect to see further growth in sales for our vehicles in 2019, too. We are looking forward to the positive impulses generated by our new products from the R 1250 boxer family, the much anticipated new S 1000 R as well as the F 850 GS Adventure which expands the mid-size BMW Motorrad model range.” The manufacturer has two new scooters planned for launch globally in 2019 and include the 400 X and C 400 GT.

डेरा सच्चा सौदा प्रमुख गुरमीत राम रहीम (Gurmeet Ram Rahim Singh Verdict Updates) को पत्रकार रामचंद्र छत्रपति (Ramchandra Chatrapati Murder Case) की हत्या के मामले में उम्रकैद की सजा सुनाई गई है. पंचकुला की सीबीआई अदालत ने गुरमीत राम रहीम को वीडियो कॉन्फ्रेंसिंग के जरिये सजा सुनाई. गुरमीत राम रहीम (Gurmeet Ram Rahim ) सहित सभी चारों आरोपियों को पत्रकार मर्डर केस में उम्रकैद की सजा सुनाई गई है. बता दें कि उम्रकैद की सजा के साथ-साथ सभी दोषियों पर 50-50 हजार रुपये का जुर्माना भी लगाया गया. सजा पर बहस के दौरान सीबीआई ने राम रहीम के लिए मौत की सजा की मांग की थी, लेकिन उसके वकील ने उसकी धार्मिक कामों का कोर्ट में हवाला दिया. बता दें कि मारे गए पत्रकार के परिवार ने दोषियों को मृत्युदंड दिए जाने की मांग की थी.

बता दें कि इससे पहले सीबीआई के वकील एचपीएस वर्मा ने बताया कि सीबीआई अदालत ने बुधवार को हरियाणा सरकार की एक अर्जी स्वीकार कर ली थी. इसमें पत्रकार रामचंद्र छत्रपति की हत्या के मामले में सजा सुनाए जाने के दौरान वीडियो कान्फ्रेंसिंग के जरिए गुरमीत राम रहीम को पेश करने की अनुमति मांगी गई थी. बता दें कि विशेष सीबीआई अदालत के न्यायाधीश जगदीप सिंह ने हत्या मामले में 11 जनवरी को गुरमीत राम रहीम और तीन अन्य – कुलदीप सिंह, निर्मल सिंह ओर कृष्ण लाल को दोषी ठहराया था. चारों को आईपीसी की धारा 302 (हत्या) और 120 बी (आपराधिक साजिश) के तहत दोषी ठहराया जा चुका है.

– पंचकुला की सीबीआई अदालत ने गुरमीत राम रहीम सहित चार दोषियों को उम्रकैद की सजा सुनाई. सजा के साथ-साथ सभी दोषियों पर 50-50 हजार रुपये का जुर्माना भी लगाया गया.



– मारे गए पत्रकार के परिवार ने दोषियों को मृत्युदंड दिए जाने की मांग की है.

– राज्य सरकार ने मंगलवार को एक याचिका दायर कर कहा था कि डेरा प्रमुख की आवाजाही के कारण कानून-व्यवस्था की स्थिति पैदा हो सकती है.

– 51 वर्षीय राम रहीम अपनी दो अनुयायियों के बलात्कार के मामले में रोहतक की सुनारिया जेल में 20 साल कारावास की सजा काट रहा है. तीन अन्य दोषी कुलदीप सिंह, निर्मल सिंह और कृष्ण लाल अम्बाला जेल में बंद हैं.

राम रहीम (Gurmeet Ram Rahim Singh) के खिलाफ सुनवाई के मद्देनजर आज हरियाणा और पंजाब के कई क्षेत्रों में सुरक्षा बढ़ा दी गई. रेप के मामले में जेल की सजा काट रहे गुरमीत राम रहीम इस मामले में भी दोषी पाए गए. हरियाणा में, विशेषकर पंचकूला, सिरसा (डेरा मुख्यालय) और रोहतक जिलों में सुरक्षा के पुख्ता इंतजाम किए गए हैं. यहां कानून व्यवस्था से जुड़ी किसी भी स्थिति से निपटने के लिए राज्य सशस्त्र पुलिस की कई कंपनियों, दंगा विरोधी पुलिस और कमांडो बल को तैनात किया जा रहा है. हरियाणा के अतिरिक्त पुलिस महानिरीक्षक (कानून-व्यवस्था) मोहम्मद अकील ने कहा, “हरियाणा में सुरक्षा कड़ी कर दी गई है.”

Delhi High Court To Hear Appeal On January 28

The Delhi High Court today said it will hear on January 28 an appeal of National Herald publisher Associated Journals Ltd (AJL), challenging a single judge order asking it to vacate its premises in New Delhi.

A bench headed by Chief Justice Rajendra Menon cited some health issues and asked whether the matter could be heard some other day.

Solicitor General Tushar Mehta, representing the Centre, and senior advocate Abhishek Manu Singhvi, appearing for AJL, agreed.

The Chief Justice said he has to undergo some surgery and can take up the matter any day after January 24.

The bench, also comprising Justice VK Rao, listed the appeal for hearing on January 28.

A single judge on December 21 last year dismissed AJL’s plea challenging the Centre’s order to vacate its premises and asked the publisher to vacate the ITO premises within two weeks after which eviction proceedings under the Public Premises (Eviction of Unauthorised Occupants) Act, 1971, would be initiated.

AJL approached the high court seeking a stay on the single judge order.

The high court had dismissed AJL’s plea challenging the Centre’s order by holding that the publisher has not provided any instance to support the serious allegations of mala fide levelled against the ruling dispensation.

The Centre had ended its 56-year-old lease and asked AJL to vacate the premises, saying no printing or publishing activity was going on. In its order, the single judge had said that AJL has been “hijacked” by Young Indian (YI), in which Congress chief Rahul Gandhi and his mother Sonia Gandhi are shareholders.

The Centre and Land and Development Office (L&DO) had said in their order that no press has functioned in the premises for at least 10 years and it was being used only for commercial purposes in violation of the lease deed.

AJL had denied the allegations in the petition filed in the high court.
The high court had said by transfer of AJL’s 99 per cent shares to YI, the beneficial interest of AJL’s property worth Rs 413.40 crore stands “clandestinely” transferred to YI.

CBI’s Rakesh Asthana Moves Delhi High Court Seeking Corrections In Judgement

New Delhi: 

Special Director of Central Bureau of Investigation (CBI) Rakesh Asthana has moved an application in the Delhi High Court, seeking some corrections in the recent judgement.

The High Court will take up his application for consideration on Thursday.

The Delhi High Court on Friday dismissed a plea filed by Mr Asthana, seeking quashing of an FIR against him in a bribery case.

The single judge bench of the High Court refused to grant interim protection to him but Justice Najmi Waziri asked the CBI to maintain the status quo for two weeks.

Mr Asthana, the number two in the CBI, had sought liberty to appeal against the High Court judgement before the Supreme Court, which was granted.

The High Court directed the CBI to conclude investigation against Mr Asthana within 10 weeks.

The court also turned down a plea by Deputy SP Devender Kumar seeking quashing of FIR filed against them.

Best union agrees to withdraw strike after Bombay High court appoints mediator

नई दिल्लीः बॉम्बे हाईकोर्ट ने बृहन्मुंबई इलेक्ट्रिक सप्लाई एंड ट्रांसपोर्ट अंडरटेकिंग (BEST) कर्मचारियों को 1 घंटे के अंदर हड़ताल खत्म करने का आदेश दिया है. हाईकोर्ट के आदेश केबाद बेस्ट के कर्मचारी हड़ताल खत्म करने पर राजी हो गए है. बेस्ट के कर्मचारी वेतन बढ़ाने की मांग को लेकर पिछले 9 दिनों से हड़ताल पर है. बेस्ट कर्मचारियों ने हड़ताल खत्म करने का ऐलान हाईकोर्ट द्वारा इस पूरे मामले को सुलझाने के लिए मीडिएटर नियुक्त किए जाने के बाद किया गया. कोर्ट ने इस मामले में हाईकोर्ट के पूर्व जज को मीडिएटर नियुक्त किया है.

याचिकाकर्ता के वकील दत्ता माने के ज़ी मीडिया से बातचीत के दौरान कहा, ‘सरकार ने जनवरी से वेतन बढ़ोतरी का आश्वासन दिया है, हड़ताल एक घंटे में हड़ताल खत्म होगी. उच्च स्तरीय कमेटी में सभी 10 मुद्दों पर यथाशीघ्र विचार कर निर्णय लिया जाएगा. इसके साथ ही हड़ताल पर गए कर्मचारियों पर कोई कार्रवाई नहीं होगी.’

कोर्ट में दलील देते हुए कर्मचारी यूनियन के वकील ने कहा, ‘हम हड़ताल खत्म करने के लिए तैयार है, लेकिन हमारी दो अहम मांगे है. पहली हम केवल बेस्ट से कोई डील नहीं करना चाहते हैं. हम चाहते है कि इसमें कोई ऐसा शख्स मध्यस्थता करे जो हमारे मुद्दों को समझता हो लेकिन वह ब्यूरोक्रेट ना हो. दूसरा हम 10 चरणों वाले इंक्रीमेंट की जगह 15 चरणों वाले इंक्रीमेंट की मांग करते हैं.’ 

यह बृहन्मुंबई इलेक्ट्रिक सप्लाई एंड ट्रांसपोर्ट अंडरटेकिंग (BEST) के इतिहास में अब तक की सबसे लंबी हड़ताल है. विभिन्न मांगों को लेकर आठ जनवरी से बेस्ट के 32 हजार से अधिक कर्मचारी हड़ताल पर हैं. उनकी मांगों में वेतन वृद्धि, कनिष्ठ स्तर के कर्मचारियों के लिए वेतन मान में सुधार और नुकसान में चल रही बेस्ट के बजट का बृहन्मुंबई महानगरपालिका (बीएमसी) के बजट के साथ विलय शामिल हैं.

हाईकोर्ट ने मंगलवार को बेस्ट कर्मचारी संघ को हड़ताल वापस लेने पर अंतिम निर्णय लेने और बुधवार तक अदालत को उसकी सूचना देने का निर्देश दिया था. बेस्ट ने अदालत को बताया था कि वह अपने कर्मचारियों को अंतरिम वेतन वृद्धि देने पर राज्य सरकार की उच्चाधिकार प्राप्त समिति द्वारा सुझाए गए कदमों को लागू करना चाहता है. इसके बाद अदालत ने ये निर्देश दिए.

मुख्य सचिव की अध्यक्षता वाली उच्चाधिकार प्राप्त समिति ने सिफारिश की कि हड़ताल बंद करने के लिए अंतरिम राहत के तौर पर समयबद्ध तरीके से करीब 15,000 कर्मचारियों के लिए वेतन में ‘10 चरण की वृद्धि’ दी जाए. हालांकि बेस्ट कर्मचारी संघ के नेता शशांक राव ने मंगलवार को प्रस्ताव खारिज कर दिया. संघ बेस्ट के बजट का बीएमसी में विलय करने की अपनी मांग को लेकर अड़ा हुआ है. बेस्ट के एक वरिष्ठ अधिकारी ने बताया कि सरकार इस मांग पर गंभीरता से विचार कर रही है.

एक अधिकारी ने कहा, ‘‘उच्चाधिकार प्राप्त समिति दोनों बजटों का विलय करने पर गंभीरता से विचार कर रही है. इस पर जल्द ही फैसला लिया जा सकता है.’’ इस बीच, हड़ताल के कारण यात्रियों की मुसीबतें बनी हुई है. हालांकि महाराष्ट्र राज्य सड़क परिवहन निगम (एमएसआरटीसी) ने उनकी परेशानियों को कम करने के लिए अपनी बसें उतारी हैं. बेस्ट के एक ड्राइवर ने असुविधा के लिए यात्रियों से माफी मांगी लेकिन साथ ही उनसे बस कर्मचारियों के सामने पेश आ रही समस्याओं को समझने की अपील भी की.

ड्राइवर ने कहा, ‘‘हम पिछले कुछ वर्षों से आर्थिक रूप से परेशान चल रहे हैं. हमारे पास हड़ताल करने के अलावा कोई विकल्प नहीं था लेकिन हमें उम्मीद है कि यह जल्द खत्म हो जाएगी.’’ कुछ यात्रियों ने सोशल मीडिया पर अपनी भड़ास निकाली. बेस्ट के बेड़े में 3,200 से अधिक बसें हैं जो महानगर और पड़ोसी ठाणे जिले तथा नवी मुंबई में चलती हैं. मुंबई में लोकल ट्रेनों के बाद यह यातायात का दूसरा सबसे बड़ा साधन है. बेस्ट की बसों में हर दिन 80 लाख से अधिक यात्री सवार होते हैं.

Bombay High Court Orders 3 Accused In Gauri Lankesh Murder From Bengaluru To Mumbai

Gauri Lankesh was shot dead outside her Bengaluru residence in 2017.


The Bombay High Court on Monday ordered that three accused in the Gauri Lankesh murder case be shifted from a Bengaluru jail to Mumbai’s Arthur Road prison to enable them to file affidavits and defend a petition by the Maharashtra ATS seeking their custody in an arms haul case.

Justice Mridula Bhatkar gave the direction when hearing an application filed by the state Anti-Terrorism Squad seeking custody of the three accused – Amol Kale, Amit Baddi and Ganesh Miskin.

In October 2018, the ATS took custody of the three for their alleged involvement in a case pertaining to recovery of arms at Nalasopara on outskirts of Mumbai. They were then produced before a Mumbai sessions court, which remanded them in ATS custody for six days.

The sessions court later refused to extend their police remand and sent them to judicial custody following which they were shifted to Bengaluru.

Special public prosecutor Raja Thakar told the high court that the previous six-day police remand was not sufficient for the ATS investigation.

Justice Bhatkar, after hearing brief arguments, issued notices to the three accused through the superintendent of the central prison in Bengaluru. “It is directed that these respondents/accused are to be transferred from the central prison in Bangalore to Arthur Road jail in Mumbai to enable them to reply and defend this case,” the court said in its order.

The judge directed the state government and additional director general of ATS to make necessary security arrangements for transferring the accused from Bengaluru to Mumbai.
